Terms of Service

Welcome to Void Hosting ("we", "our", "us"). By registering for, accessing, or using our hosting services, you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms in their entirety, you must not use our services.

1. Acceptance of Terms

By creating an account, accessing, or using any Void Hosting service, you represent and warrant that you are at least 18 years of age, or that you are the legal age of majority in your jurisdiction, and possess the legal authority to enter into this agreement. If you are under 18, you may use our services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these ToS.

These ToS, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Void Hosting regarding your use of our services.

2. Services Provided

Void Hosting provides the following categories of services:

  • Virtual Private Server (VPS) Hosting — KVM-based virtual servers with dedicated resources.
  • Game Server Hosting — Managed and unmanaged game server environments, including but not limited to Minecraft.
  • Web Hosting — Shared and reseller web hosting solutions.
  • Ancillary Services — DDoS protection, automated backups, and related infrastructure services.

Service Availability: While we strive to maintain maximum uptime, we do not guarantee uninterrupted service. Scheduled maintenance, emergency repairs, hardware failures, network issues, or force majeure events may result in temporary service interruption. No service-level agreement (SLA) or uptime guarantee is provided unless explicitly agreed to in writing.

3. Account Registration & Security

You agree to:

  • Provide accurate, current, and complete information during registration and keep it updated.
  • Maintain the confidentiality of your account credentials and accept responsibility for all activities occurring under your account.
  • Notify us immediately of any unauthorized use of your account or any other security breach.
  • Not share, sell, transfer, or license your account to any third party without our prior written consent.

We reserve the right to suspend or terminate accounts with false or misleading registration information.

4. Payments & Billing

4.1 Payment Terms

All fees are payable in advance for the selected billing cycle. We currently accept payments via Stripe and PayPal. You authorize us to charge your selected payment method for all recurring fees and any applicable taxes.

4.2 Late Payments & Suspension

Failure to pay within 3 days of the invoice due date may result in service suspension. After 7 days of non-payment, your service may be terminated and all associated data permanently deleted. We are not liable for any data loss resulting from suspension or termination due to non-payment.

4.3 Price Changes

We may modify our pricing at any time. For existing subscriptions, price changes will take effect at the next renewal period. We will provide at least 30 days' notice of any price increase. Continued use after a price change constitutes acceptance of the new pricing.

4.4 Refunds

Refunds are governed exclusively by our Refund Policy. Unless otherwise stated, we do not provide prorated refunds for partial usage or early cancellation.

5. Acceptable Use Policy

You are solely responsible for all content, data, and activity that occurs on your Void Hosting services. You agree not to use our services for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our infrastructure.

5.1 Prohibited Content

You may NOT use our services to host, store, transmit, or distribute:

  • Malware, viruses, trojans, ransomware, spyware, or any other malicious software.
  • Phishing pages, scam websites, or fraudulent schemes of any kind.
  • Child sexual abuse material (CSAM) or any content that exploits or harms minors.
  • Content that infringes on copyrights, trademarks, trade secrets, or other intellectual property rights.
  • Pirated software, warez, or illegal downloads.
  • Hate speech, content that promotes violence, or content that discriminates against protected groups.

5.2 Prohibited Activities

You may NOT use our services to:

  • Send spam, bulk unsolicited email, or unsolicited advertising of any kind.
  • Conduct port scanning, vulnerability scanning, or penetration testing without explicit written authorization.
  • Launch, facilitate, or participate in distributed denial-of-service (DDoS) attacks.
  • Mine cryptocurrency without prior written approval.
  • Run proxy or VPN services for public resale without explicit authorization.
  • Host TOR exit nodes or similar anonymization services.
  • Engage in any activity that violates applicable local, national, or international laws.

5.3 Resource Abuse

You may not consume excessive resources that negatively impact the performance or stability of our shared infrastructure. We reserve the right to throttle, limit, or suspend services that cause resource abuse, including but not limited to excessive CPU, RAM, disk I/O, or network bandwidth consumption.

6. Data & Backups

You are solely responsible for maintaining independent backups of all data stored on our servers. While we may offer automated backup services as a convenience, we do not guarantee the completeness, integrity, or availability of any backup. We are not liable for any data loss, corruption, or deletion, regardless of cause.

By using our services, you acknowledge that data loss is an inherent risk of hosting and agree to maintain your own disaster recovery plan.

7. Intellectual Property

You retain all ownership rights to any content, data, or materials you upload, host, or transmit using our services. By uploading content, you grant Void Hosting a limited, non-exclusive, royalty-free license to store, transmit, and display such content solely as necessary to provide the hosting services.

We respect the intellectual property rights of others. If you believe content hosted on our network infringes your copyright, please contact us at abuse@voidhosting.vip with a detailed DMCA takedown notice.

8. Account Suspension & Termination

We reserve the right to suspend, restrict, or terminate your account and services immediately and without prior notice if:

  • You violate any provision of these ToS or our Acceptable Use Policy.
  • Your use poses a security risk, disrupts our network, or harms other users.
  • We are required to do so by law, regulation, or court order.
  • You fail to make timely payment for services rendered.
  • You engage in fraudulent or abusive behavior toward our staff or systems.

Upon termination, your right to use our services ceases immediately. We may delete all data associated with your account without further notice. Termination does not relieve you of any outstanding payment obligations.

9. Privacy & Data Protection

We collect and process only the minimum personal information necessary to provide and bill for our services. We do not sell, rent, or trade your personal data to third parties for marketing purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that our services will be uninterrupted, timely, secure, or error-free.
  • We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use or inability to use our services, including but not limited to loss of profits, data, goodwill, or other intangible losses.
  • Our total aggregate liability to you for any claim arising out of or relating to these ToS or our services shall not exceed the total amount you paid us in the 12 months preceding the event giving rise to liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Void Hosting, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our services; (b) your violation of these ToS; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you host or transmit through our services.

12. Third-Party Services & Advertisements

Our website may contain links to third-party websites, services, or advertisements (including Google AdSense). We do not endorse, control, or assume responsibility for any third-party content, products, services, or privacy practices. Your interactions with third parties are solely between you and the third party.

13. Changes to These Terms

We may revise these Terms of Service at any time at our sole discretion. Material changes will be posted on this page with an updated "Last Updated" date. We will also notify active customers via email or through our client portal of material changes.

Your continued use of our services after any changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using our services and cancel your account.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Void Hosting operates, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these ToS or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved exclusively in the courts of our operating jurisdiction.

15. Severability

If any provision of these ToS is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these ToS. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Void Hosting and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.
